Please read these Terms & Conditions carefully before using the WeightFree app or website. By creating an account or using our service, you agree to be bound by these terms.

1. Who We Are

WeightFree ("we", "us", "our") operates the WeightFree digital wellness application, which provides AI-assisted, personalised 12-week weight-loss and behaviour-change programmes. Our support email is support@weightfree.rolandb31.com. We are established in the Netherlands and our services are governed by Dutch and applicable European Union (EU) law.

2. Who Can Use WeightFree

You must be at least 18 years old to use WeightFree. By accepting these terms you confirm that you meet this requirement. WeightFree is intended for general wellness and habit-formation support only. It is not a medical service and does not replace the advice of a qualified doctor, dietitian, or other healthcare professional. If you have any medical condition, eating disorder, or health concern, please consult a healthcare professional before starting any programme.

3. The Service

WeightFree provides a digital subscription service that includes:

A personalised 12-week behaviour-change and weight-management programme generated on the basis of your onboarding assessment answers.
Daily missions, weekly challenges, milestone tracking, and success metrics.
AI-generated coaching content covering nutrition guidance, habit formation, exercise recommendations, craving management, sleep optimisation, and stress management.
Motivational coaching messages personalised to your profile.

The programme is generated by artificial intelligence and is not a substitute for individualised professional medical or dietary advice. Recommendations are designed to be realistic and sustainable, but results vary between individuals and are not guaranteed.

4. Subscription and Billing

WeightFree is offered on a recurring subscription basis. The following terms apply to all paid plans:

Billing cycle: Your subscription fee is charged at the start of each billing period (monthly or annually, depending on the plan you select).
Auto-renewal: Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date. By subscribing, you explicitly authorise us to charge the payment method on file at the then-current price.
Price changes: We will give you at least 30 days' advance written notice (by email) of any price increase. If you do not cancel before the new price takes effect, your continued use will be deemed acceptance of the new price.
Payment processing: Payments are processed by third-party payment processors (see Section 9). We do not store your full payment card details.
Failed payments: If a payment fails, we may suspend access to your account until payment is received. We will notify you by email.

5. Cooling-Off Period (Right of Withdrawal)

Under Dutch law implementing EU Directive 2011/83/EU (the Consumer Rights Directive), you have the right to withdraw from a distance contract within 14 calendar days of the date your subscription begins ("cooling-off period"), without giving any reason.

If you request immediate access to the digital content or service at the time of purchase (which WeightFree provides by default), and you explicitly acknowledge that you lose your right of withdrawal once performance has begun, the right of withdrawal will be lost from the moment the service is first made available to you. We will ask for this acknowledgement at checkout.

If you have not requested immediate access, you may exercise your right of withdrawal within 14 days by contacting us at support@weightfree.rolandb31.com with a clear statement of your decision to withdraw. You may also use the standard model withdrawal form available from the Dutch Authority for Consumers and Markets (ACM).

Where a valid withdrawal right applies and is exercised, we will reimburse all payments received from you within 14 days using the same payment method as your original transaction.

6. Cancellation

You may cancel your subscription at any time. Cancellation stops future billing but does not automatically entitle you to a refund for the current billing period already paid, except where our Refund Policy or statutory rights provide otherwise. To cancel, log in to your account settings and follow the cancellation steps, or email us at support@weightfree.rolandb31.com. We will confirm your cancellation by email.

7. User Account

You are responsible for keeping your login credentials secure and for all activity that occurs under your account. Please notify us immediately at support@weightfree.rolandb31.com if you suspect unauthorised access. You may not share your account with others or use the service on behalf of another person without their consent.

8. Acceptable Use

You agree not to:

Use WeightFree for any unlawful purpose.
Attempt to reverse-engineer, scrape, or copy our AI models or content.
Upload harmful, offensive, or misleading content.
Misrepresent your identity or provide false information in your assessment.
Resell or redistribute the programme content without our written permission.

We reserve the right to suspend or terminate accounts that breach these rules.

9. Third-Party Services

WeightFree uses third-party providers to deliver the service, including:

Payment processors (e.g. Stripe or Mollie) to handle subscription billing securely.
Email service providers (e.g. Postmark or Mailchimp) to send transactional and marketing communications.
AI infrastructure providers (e.g. OpenAI) to generate personalised programme content.
Hosting and cloud providers to store and serve the application.

These providers process your data only as necessary and under appropriate data processing agreements. See our Privacy Policy for more detail.

10. Intellectual Property

All content provided through WeightFree — including text, programme structures, coaching content, graphics, and AI-generated outputs — is owned by or licensed to WeightFree. You are granted a limited, personal, non-transferable licence to use this content for your own personal wellness purposes only. Nothing in these terms transfers any intellectual property rights to you.

11. Disclaimer of Warranties

WeightFree is provided "as is". We do not guarantee that:

The service will be uninterrupted or error-free.
The AI-generated programme will achieve specific weight-loss or health outcomes.
The recommendations are suitable for your individual medical circumstances.

Nothing in these terms limits your statutory rights as a consumer under Dutch or EU law.

12. Limitation of Liability

To the fullest extent permitted by Dutch law, WeightFree's total liability to you for any claim arising from your use of the service is limited to the total subscription fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential losses. We do not exclude liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

13. Changes to These Terms

We may update these Terms & Conditions from time to time. We will notify you of material changes at least 30 days in advance by email or in-app notice. Continued use after the effective date of changes constitutes acceptance. If you do not agree with changes, you may cancel your subscription before they take effect.

14. Governing Law and Disputes

These terms are governed by the laws of the Netherlands. Any disputes that cannot be resolved amicably will be submitted to the competent court in the Netherlands. As an EU consumer, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
